TERMS AND CONDITIONS


Please read the following terms and conditions before booking.

By choosing to book our facility, you agree to be bound by these terms and conditions of sale specified
herein and any other provision as may be specified from time to time by D20 Dungeon.

Bookings are made and sold subject to the following conditions:
1) Your booking of a given date will entitle you to access the 2501 North Wheeling Avenue, Muncie,
Indiana 47303 (“Premises”), beginning at 10:00 a.m. on your booking date and ending at 11:00
p.m. on said date. During that time period, you are permitted to access the dungeon room and
restrooms at the Premises. All other parts of the Premises are strictly off-limits.

2) You will be provided with a keypad code after you book the Premises which will allow you to
access the Premises during the time provided.

3) You are permitted to bring nine (9) guests with you to the Premises. By booking the room, you
agree that you and your guests will adhere to the terms laid out herein. It is your responsibility to
make your guests aware of these terms and conditions. You agree to be personally responsible for
the actions of your guests and their adherence to these terms and conditions. You specifically agree
that you shall be personally responsible for any damage to the Premises, damage to the game
materials provided, as well as any other violation of these terms and conditions by your guests.
You further agree to indemnify and hold D20 Dungeon harmless from any and all claims which
arise from your guest’s presence at the Premises.

4) D20 Dungeon, their agents or employees shall not be liable for any personal injury, loss, damage
or death caused or which occurs as a result of you and your guest’s presence at the Premises.

5) D20 Dungeon reserves the right to cancel your booking and/or refuse entry to you or your Guests
at any time.

6) You are booking this Premises for use as a venue to play Dungeons and Dragons and other games
of that nature. Any use of the Premises outside of this will be considered a violation of this
agreement and may result in D20 Dungeon immediately ending your use of the Premises.

7) Illegal activity is strictly prohibited on the Premises. Individuals may not use or be under the
influence of illegal drugs while at the Premises. Smoking and vaping of any substance whatsoever
is prohibited at the Premises.

8) D20 Dungeon is providing you with game materials and components as part of your booking. You will be
responsible for the replacement of any damaged or missing items. You are encouraged to report
any missing items at the commencement of your booking.

9) You have expressly agreed to participate, join, enter, use, play and/or access the Premises at your
sole risk. To the fullest extent permissible by applicable law, D20 Dungeon disclaims all warranties,

express or implied, including but not limited to, implied warranties, merchantability or fitness. D20
Dungeon does not warrant the reliability, accuracy, completeness, current or error-free of the
product, content and materials included, used or deployed on the Premises. If a product, content or
material is not as described, you have expressly waived the right to claim any damages and/or
losses including but not limited to direct, indirect, incidental, punitive and consequential damages
deriving from such use or reliance of the description of the product, content or material.

10) You agree not to carry or bring any dangerous, harmful or hazardous object on the Premises
including, but not limited to, sharp objects, explosive items, weapons or item deemed to be
dangerous or harmful to other visitors on the Premises. In the event that such item or object is
found, D20 Dungeon, their employee or agent shall have the power, authority and consent
expressly granted by you to decline or refuse your entry to the Premises.

11) You are permitted to bring your own food and drinks to the Premises. You are responsible for
disposing of any refuse and cleaning up all food, wrappers, containers, and drinks which you bring
to the Premises. Alcohol is permitted at the Premises provided that it is consumed responsibly and
in accordance with the laws of the State of Indiana. You and your guests are also prohibited from
drinking to the point of intoxication. You specifically agree to indemnify and hold D20 Dungeon
harmless from any and all claims which arise from you and your guest’s consumption of alcohol
at the Premises.

12) You agree that you and your guests will conduct yourselves in accordance with the instruction,
command and rules specified by D20 Dungeon, failing which D20 Dungeon, their employees, or
agent shall have the right and power to immediately terminate your booking and you will be asked
to leave the Premises immediately. In the event this occurs, you will not receive a refund.

13) All items including, but not limited to, your personal belongings, objects, luggage, baggage,
watches, wallets, items and/or property, shall be kept by you at your sole risk. In any event, D20
Dungeon, their employees, or agents shall not be held liable or responsible for any loss of your
personal belongings within the Premises or outside of the Premises. The risk of loss for your
personal belongings shall be borne by you upon entrance on the Premises or engagement with the
D20 Dungeon business.

14) You shall not be allowed to record, capture or snap any photograph, video, film, tape or audio
recording whatsoever before, during and after the game, except with the explicit permission of D20
Dungeon. If such recording activity is found within the Premises, D20 Dungeon, reserves the
power, authority and consent expressly granted by you to delete, remove or transfer such recording
to any device, media or hardware owned by D20 Dungeon, the copyright of such recordings will
deemed automatically granted by you to D20 Dungeon. You agree to remove any and all photos
or recordings referenced in this Paragraph from all social media or other websites if requested to
do so by D20 Dungeon.

15) To the fullest extent permissible by applicable law; D20 Dungeon, their employees and agents shall
not be responsible for any risk, hazard, danger, security, threat, safety and/or protection for the
game. You shall be solely responsible, answerable and accountable for your personal safety,
security, body condition, disease transmission, pregnancy or health condition, while you
participate, join, enter, use, play and/or access the Premises.

16) Website Use. The website http://www.d20dungeon.net is owned and operated by D20 Dungeon.
The company holds the right to amend or vary these terms and conditions including any of the
contents of the website from time to time at its sole discretion without prior notice. The hereinafter
terms apply to the use by any visitor to the website and should be read carefully before any use:
A) D20 Dungeon does its best to supply you with the most current and accurate information on its
website.
B) You are not permitted to link to or use all or any part of D20 Dungeon’s website for any purpose
which is fraudulent, unlawful, defamatory, harmful, obscene or objectionable.
C) You accept that the Internet is not fully secure. D20 Dungeon will take all appropriate steps to
protect the security of any payment card information, though D20 Dungeon shall not be liable
for any damage that you may suffer as a result of the loss of confidentiality of any such
information.

17) Data Protection and Data Security
A) D20 Dungeon collects and stores your personal details without disclosing it to any third party
and is dedicated to ensuring that the privacy of your personal information is protected as
governed by law.
B) D20 Dungeon may contact you from time-to-time with offers and promotions via email or
phone.
C) The trademarks and logos displayed on the website are the property of D20 Dungeon. You are
not permitted to use these without the prior written permission of D20 Dungeon and you accept
that any such use may constitute an infringement of the relevant proprietor’s rights.
D) All the terms of any contract are included or assigned to within these terms and conditions.
18) Bookings and Attendance
A) Only person(s) who are at least 18 years of age are permitted to book the Premises.
B) All ages are welcome at our Premises, however players aged 16 years and under must be
accompanied by at least one adult, aged 18 or over. You specifically agree that you will ensure
that you will not expose or allow any person to engage in any activity that is prohibited by the
nature of the persons age.
C) Your booking is non-transferable. Games may not be transferred or resold for commercial
purposes or at a premium. If a game is transferred or resold in breach of this condition, the
bearer of the game or the person claiming the right to attend the event will be refused admission
to the game.

D) You are entirely responsible for entering your details correctly on the online booking form. By
submitting an online booking form, you warrant to D20 Dungeon that all details supplied by
you are true and accurate.
E) You will receive a confirmation of your booking via email only. D20 Dungeon does not send
confirmation via post or text message.
F) In order to book the room for a given date, you must the required credit card information which
will not be charged until the date of your booking. You specifically authorize D20 Dungeon to
charge the price of the booking to your credit card. You further authorize and agree that D20
Dungeon may charge your credit card for any damage to the Premises that is caused by your
and/or your guests during your booking. Further, you authorize and agree that D20 Dungeon
may charge your credit card for any game materials or other items that are missing or damaged
during your booking.
G) You may cancel your booking free-of-charge twenty-four (24) hours prior to the date that your
booking date. After that time the booking is final and you will be charged the quoted price
regardless of whether or not you actually appear at the Premises.
H) A maximum of ten (10) people may enter and utilize the Premises.
I) Each player will participate in the game at their own risk. D20 Dungeon is not liable for any
(personal or equipment) damages caused by game room misuse or not following the rules
described before the game.
J) To be admitted, you must confirm the full name on the booking and might be asked to confirm
the phone number and/or email address.
K) It is your responsibility to wear the proper and suitable attire including, but not limited to,
footwear and clothing before the commencement of the game.

19) Miscellaneous
A) While you are at the Premises, you must ensure to conform to these terms and conditions, adopt
proper standards of behavior, and co-operate with our D20 Dungeon’s agents and employees.
B) In the event that you breach these terms and conditions, in addition to the remedies outlined
herein, D20 Dungeon has the right to enforce the terms and conditions herein utilizing all
remedies available under the law. In the event that D20 Dungeon employs an attorney to
enforce the terms of this agreement, it shall have the right to recover its attorney fees.
C) Any and all claims disputes, or controversies of any nature whatsoever (whether in contract,
tort or otherwise, including statutory, common law, fraud (whether by misrepresentation or by
omission) or other intentional tort, property, or equitable claims) arising out of, relating to, or
in connection with (1) your booking and use of the Premises; and (2) the validity, scope,
interpretation, or enforceability of this provision or of the entire agreement (“Claim”), shall be
resolved by binding arbitration before a single arbitrator. All arbitrations shall be administered

by the American Arbitration Association (“AAA”) in accordance with its Expedited Procedures
of the Commercial Arbitration Rules of the AAA in effect at the time the claim is filed. The
terms of this provision shall control any inconsistency between the AAA’s Rules and this
provision. You may obtain a copy of the AAA’s rules by calling (800) 778-7879. Upon written
request, D20 Dungeon will advance to you either all or part of the fees of the AAA and of the
arbitrator. The arbitrator will decide whether you or D20 Dungeon will be responsible for these
fees. The arbitrator shall apply relevant substantive law and applicable statute of limitations
and shall provide written, reasoned findings of fact and conclusions of law. This provision is
part of a transaction involving interstate commerce and shall be governed by the Federal
Arbitration Act, 9 U.S.C. § et seq. If any portion of this Arbitration Provision is deemed invalid
or unenforceable, it shall not invalidate the remaining portions of the Arbitration Provision.
This Arbitration Provision shall inure to the benefit of and be binding on you and D20 Dungeon
and its Provisions shall continue in force and effect subsequent to and notwithstanding the
expiration of termination of this Agreement. Any and all disputes will be resolved in
accordance with the laws of the State of Indiana.
